Terms and Conditions – Brisbane Economic Development Agency - Visit Brisbane Competition 

1. These terms and conditions set out all of the information regarding the Brisbane Economic Development Agency – Visit Brisbane Competition (the Terms and Conditions).

2. The promoter of this competition is Brisbane City Council ABN 72 002 765 795 whose principal offices are at 266 George Street Brisbane 4000, acting through its wholly owned subsidiary, Brisbane Economic Development Agency Pty Ltd ACN 094 633 262 (the Promoter). 

3. Information on how to enter this competition forms part of these Terms and Conditions. 

4. Competition entry is deemed acceptance of these Terms and Conditions. 

5. Prizes: There are two (2) prizes available to be won for this competition, where the prize consists of one (1) unique package (the Prize) consisting of the following: 

(a) ‘Inner Sanctum’ experience for two (2) organised by PGA of Australia and Golf Australia. Experience includes ‘Inside the Ropes’ on any one day with a leading group, tours of the broadcast facilities, participants‘ lounge and locker room. To be redeemed on one (1) day of the 2024 BMW PGA Championship, 21 – 24 November 2024. 

The total value of this prize inclusion is approximately $2,800.

(b) Overnight stay in a King Room with breakfast for two at Hotel X, located at 458 Brunswick St, Fortitude Valley QLD 4006 to be redeemed prior to 4 November 2025. Booking subject to hotel availability. Blackout dates apply.

The total value of this prize inclusion is approximately $546. 

The total value of the Prize, being the unique package as described above in (a) - (b), is approximately $3,346. 

7. How to enter: Entrants must fully complete and submit the online entry from found at: https://visit.brisbane.qld.au/competitions  

Only one entry per entrant will be accepted, and any subsequent entries from the same entrant will be deemed invalid. 

8. Eligibility: To be eligible to enter this competition, a person must:

(a) follow @visitbrisbane on Instagram;

(b) not be an employee or contracted staff of the Promoter or prize providers; and

(c) be 18 years of age or older.

9. Competition draw: The winners of the competition will be the first two eligible entries randomly drawn by an officer of the Promoter at approximately midday AEST on 31 October 2024.

The decision of that officer shall be conclusive and no correspondence will be entered into.

Winner notification: The winners will be notified via phone or email by an officer of the Promoter by 5pm AEST on 1 November 2024. 

10. Prize claim and Prize re-draw: The winners must claim the Prize by contacting the Promoter on the details notified by the Promoter (either by phone or email), by 10.00am AEST on 4 November 2024 (the Prize Claim Date). 

If a Prize is not claimed by the Prize Claim Date, the winner (as originally drawn) will cease to be the winner and will not be entitled to claim the Prize. 

The Promoter will be entitled to re-draw a new winner and provide a period of time for that new winner to claim that Prize. If that new winner fails to claim the Prize in the applicable period of time, that new winner will cease to be the winner and will not be entitled to claim the Prize.  This re-draw process may continue to apply on any number of occasions (at the discretion of the Promoter), until such time as the Prize is claimed by the winner within the applicable period. 

The Promoter, in its absolute discretion, reserves the right not award the Prize to any entrant, including without limitation, if the Prize is not claimed by the Prize Claim Date or any subsequent period provided for a new winner to claim the Prize. 

11. Prize redeem: To redeem the Prize, once a Prize winner has claimed the Prize and provided an email address, the Prize will be sent out to the Prize winner by email. 

12. No liability of Promoter: The Promoter accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of the Prize. Despite any other provision of these Terms and Conditions, to the maximum extent permitted by law, the Promoter is not liable for: 

(a) any loss or damage whatsoever (including but not limited to direct loss, indirect loss, economic loss, special loss or consequential loss) which is suffered or incurred by an entrant (including without limitation any Prize winner); or

(b) without limiting paragraph (a), any personal injury or death or loss of, or damage to, property in connection with the entry into the competition or acceptance of the Prize, 

howsoever such liability arises and whether arising in tort (including without limitation in negligence), for breach of contract (including without limitation under any indemnity), under statute, in equity of otherwise.

This condition is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws.  Any such liability is limited to the resupply of the Prize. 

13. Privacy consent: By entering this competition, the entrant acknowledges and consents to their personal information being collected, stored and shared by the Promoter for the purpose of this competition and the providing of the prizes as describe in the above clause 5 (a) to (h).

14. Force Majeure: If for any reason this competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter), which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition. The Promoter reserves the right in its sole discretion to disqualify all entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.

15. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same Terms and Conditions. 

16. Competition updates or cancellation: Council reserves the right to modify these Terms and Conditions at any time, including amending key dates and times in conditions 6, 9 and 10 of these Terms and Conditions, and to cancel or amend the competition at any time without notice or further recourse to the entrants.
